Australia’s competition regulator has released guidelines to help new and existing aged care home service providers understand their rights and obligations under existing competition and consumer laws.
The Australian Competition and Consumer Commission guidelines come in response to increased competition in the sector resulting from greater consumer choice under the consumer directed care model.
The ACCC released Home care services – know your business rights and obligations under the competition and consumer law in July.
The resource is designed to help private and not-for-profit organisations who provide home care to older Australians understand their rights and obligations under the Competition and Consumer Act including the Australian Consumer Law, the ACCC says.
The guide covers home care agreements, dealing with home care customers, handling complaints, business rights and fair competition. It also includes case studies and examples of where breaches have occurred in the past.
The guidelines include a good-practice checklist to help home care businesses comply with consumer and competition laws, as well as links to more resources and information.
The ACCC has also released a separate set of guidelines for consumers, Home care – know your consumer rights, targeting people who purchase home care goods and services or receive them through a government-funded Home Care Package.
